What do Florida laws say about buying a gun?

Understanding Florida’s Laws for Purchasing a Firearm

Purchasing a firearm in Florida involves navigating a set of legal requirements designed to ensure the safety of both individuals and the public. If you’re interested in purchasing a firearm in Florida, it’s important to understand the key laws that govern the process. Below is a comprehensive guide to help you understand what’s involved in legally buying a firearm in the state.

1. Eligibility Requirements

To legally purchase a firearm in Florida, buyers must meet certain eligibility criteria. These include:

  • Age Requirement: You must be at least 21 years old to purchase a firearm from a licensed dealer. However, individuals 18 years or older can buy long guns (such as rifles and shotguns) from private sellers.
  • U.S. Citizenship or Legal Residency: You must be a U.S. citizen or a legal permanent resident to purchase a firearm. Non-citizens can purchase firearms if they have a valid visa or immigration status.
  • No Felony Convictions: You cannot purchase a firearm if you have been convicted of a felony or if you are under indictment for a felony.
  • No Domestic Violence Convictions: Individuals with a history of domestic violence convictions or active restraining orders may be prohibited from purchasing a firearm.
  • Mental Health: Florida law prohibits the purchase of firearms by individuals who have been adjudicated as mentally defective or have been committed to a mental institution.

2. Federal Background Check (NICS)

Florida follows federal law regarding background checks for firearm purchases. All buyers, whether purchasing from a licensed dealer or a private seller (in some cases), must undergo a background check through the National Instant Criminal Background Check System (NICS). The check typically includes reviewing criminal history, mental health status, and any restraining orders.

  • Licensed Dealers: If you are buying from a Federal Firearm License (FFL) dealer, the background check is mandatory.
  • Private Sellers: Florida law allows private transactions between individuals, but they are encouraged to use a licensed dealer to facilitate a background check. This is not required by law, but it is considered a best practice to ensure that the transaction is legal.

3. Waiting Period

Florida has a mandatory three-day waiting period for handgun purchases. This applies to all individuals purchasing a handgun from a licensed dealer. The purpose of this waiting period is to allow time for the background check and for the buyer to reconsider their purchase. However, this waiting period does not apply to long guns, such as rifles or shotguns.

  • The waiting period may be waived for certain individuals, including those with a concealed carry permit.

4. Concealed Carry Permits

Florida offers a Concealed Carry Permit for those who wish to carry a firearm in public. To obtain a concealed carry permit, you must:

  • Be at least 21 years of age.
  • Pass a background check (similar to the NICS check).
  • Complete a firearms safety training course.
  • Submit an application to the Florida Department of Agriculture and Consumer Services (FDACS).

Once issued, the permit allows you to carry a concealed firearm in public spaces, provided you follow all local laws and regulations.

5. Firearm Registration

Florida does not require the registration of firearms. However, firearm owners are responsible for keeping their weapons secure and ensuring they are not used in crimes. When you purchase a firearm in Florida, you will be required to fill out an ATF Form 4473 (a federal form) and undergo a background check, but there is no state database of firearm ownership.

6. Open Carry Laws

Florida generally prohibits the open carry of firearms, with a few exceptions. For instance, individuals who have a concealed carry permit can carry their firearm in public, but it must be concealed from view. Open carry is allowed in certain situations, such as while hunting, fishing, or camping.

7. Storage Laws

Florida law does not mandate the safe storage of firearms, but gun owners are encouraged to keep their firearms secure, particularly from children and unauthorized users. Florida law does require that gun owners use reasonable precautions to prevent access to firearms by children under 16.

8. Private Sales and Transfers

Private sales of firearms between individuals are generally legal in Florida. However, both parties are advised to be cautious and ensure that the buyer meets the eligibility criteria. To ensure the transaction is legal, it is highly recommended that private sellers conduct a background check through a licensed dealer.

Conclusion

Understanding Florida’s firearm laws is critical for any prospective gun owner. From meeting the eligibility requirements to completing the necessary background checks, every step in the process is designed to promote public safety while ensuring legal access to firearms. Always make sure to stay informed and consult legal experts if you have any questions about specific regulations.
