Springfield Armory is pleased to announce a highly anticipated new addition to their polymer pistol lineup, the XD-M= 10mm. This full-size pistol is the latest variation in the series, now chambered in the popular 10mm round for more power in the highly accurate and reliable XD(M) platform.
One of the most important rules of gun safety is to always keep the gun pointed in a safe direction – that is, pointed in such a way that even if it were to go off, it would not cause injury or damage. Always have control of where the front end of the barrel is pointed, and note that the safest direction is not constant, but rather is dependent on the circumstances.
When you hold a gun, rest your finger on the side of the gun or on the trigger guard – keep your finger off of the trigger to avoid accidents. Only place your finger on the trigger when you are ready to fire the gun.
Store guns unloaded, and when you pick up a gun, engage the safety and remove the gun’s magazine (if it has one). If you are unsure how to check if a gun is loaded, seek advice from a professional. Always treat guns as though they are loaded until you are sure they are not.
Alcohol and other substances can impair mental and physical bodily functions, including reaction time and judgment, and should not be used before or during the handling of firearms.
Springfield, Inc. warrants to You, the original retail purchaser of the Product, that the Product You purchased will be free of defects in workmanship or material, subject to the terms of this document.
This Limited Warranty will last and be in effect during in which YOU, the original retail purchaser, owns the Product.
WHAT DO YOU HAVE TO DO FOR WARRANTY SERVICE?
You must take 3 steps to get warranty service.
WHAT WILL SPRINGFIELD DO IF YOU DISCOVER A DEFECT?
If, during YOUR ownership of the Product, one or more parts of the Product fail due to defects in materials or workmanship, Springfield will provide, free of charge, a new, repaired or reconditioned (decided at our discretion) Product. That new, repaired or reconditioned Product will be warranted for the remainder of YOUR ownership of the Product under these terms and conditions.
WHAT IS NOT COVERED BY THIS LIMITED WARRANTY?
This Limited Warranty does not cover any damage or condition determined by Springfield to be caused by:
LIMITATION OF LIABILITY AND DISCLAIMERS
THIS LIMITED WARRANTY IS PROVIDED IN LIEU OF ANY AND ALL EXPRESS WARRANTIES. ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, NON- INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE WARRANTY PERIOD (THE ORIGINAL PURCHASER'S (YOUR) OWNERSHIP OF THE PRODUCT) AND NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER SUCH PERIOD. SOME STATES DO NOT ALLOW LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
SPRINGFIELD'S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN THE PRODUCT IS LIMITED TO THE TERMS SET FORTH IN THIS LIMITED WARRANTY. THE PRECEDING LIMITED WARRANTY CONSTITUTES SPRINGFIELD'S ONLY OBLIGATION TO YOU AND REPRESENTS YOUR EXCLUSIVE REMEDY AGAINST SPRINGFIELD. IN NO EVENT WILL SPRINGFIELD BE LIABLE FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, REGARDLESS OF WHETHER YOUR CLAIMS ARE BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR OTHER THEORIES, INCLUDING, WITHOUT LIMITATION, ANY LIABILITY FOR ECONOMIC LOSS, BODILY INJURY, PROPERTY DAMAGE OR FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OR OWNERSHIP OF THE PRODUCT, WHETHER FORESEEABLE OR NOT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR CERTAIN OTHER EXCLUSIONS CONTAINED IN WARRANTIES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE LIMITATIONS SET FORTH IN THIS LIMITED WARRANTY SHALL NOT APPLY TO THE EXTENT THAT THEY ARE PROHIBITED BY LAW.
No person or entity is authorized to give any other warranty or to assume any other obligation on behalf of Springfield. Any provision of this Limited Warranty prohibited or unenforceable in any jurisdiction shall be ineffective only to the extent of such prohibition and shall not invalidate any of the remaining provisions of this Limited Warranty.
GOVERNING LAW/VENUE/CONSENT TO JURISDICTION
This Limited Warranty will be governed and construed in accordance with the law of the State of Illinois, without regard to Illinois' conflict of law rules. Any litigation between SPRINGFIELD and YOU or YOUR heirs, representatives or assigns shall be filed before a court of competent jurisdiction and venue in the 14th Judicial District of the State of Illinois. YOU HEREBY CONSENT TO THE IN PERSONAM JURISDICTION AND VENUE OF THE ILLINOIS COURTS, AND THAT SERVICE OF THE PROCESS MAY BE MADE UPON YOU AS PROVIDED BY ILLINOIS LAW.
Tritium Night Sights Excluded
This Limited Warranty does not cover on 1911-A1 pistols produced after January 1, 2001. The 1911 Tritium Night Sights are covered by the following Trijicon® Warranty: The originial owner of the Trijicon® tritium self luminous iron sight system warranted with this card is entitled to repair or replacement (at Trijicon's option) if it should fail due to defects in material or workmanship during normal use. This warranty specifically applies to the illumination system. The tritum lamps in this product are warranted against breakage for a period of twelve years from the date of the original manufacture date. If repair is necessary, please send the iron sights to Trijicon®, properly packed, including a description of your problem. This warranty does not apply to defects caused by anything which is deemed abnormal, abusive, or improper use including any fault resulting from an accident or improper service. Special Note: Trijicon® IRON SIGHTS CONTAIN TRITIUM AND ARE REGULATED BY THE NUCLEAR REGULATORY COMMISSION. THEY MAY NOT BE DISASSEMBLED BY ANYONE OTHER THAN TRIJICON INC., WHICH HOLDS THE NECESSARY LICENSES. Any attemp at disassembly or repair will annul this warranty.
